Mental Health Parity Compliance

This session will highlight some of the key elements of a Mental Health Parity and Addiction Equity Act (“MHPAEA”) compliance program so that employers can improve compliance with MHPAEA, including conducting ongoing monitoring of MHPAEA compliance for the financial/quantitative treatment limitation (“QTL”) requirements, nonquantitative treatment limitation (“NQTL”) requirements, and disclosure requirements.  We will also discuss the 2023 Report to Congress and mention some of the issues in the proposed regulations.

Many companies are reconsidering their clawback policies (situations where the employer recoups compensation paid to an employee).  This session will discuss the various reasons companies adopt clawback policies, clawback design features (what events trigger clawbacks, what types of compensation are subject to clawback, what employees are subject to the clawback policy, etc.), and the federal tax treatment of recouped compensation.

The Consolidated Appropriations Act, 2023 (SECURE 2.0) contains over 92 provisions pertaining to retirement plan benefits. This session will provide an overview of the key provisions impacting plan sponsors and their retirement plans. The presentation will provide an overview of the deadlines and next steps for employers to implement the provisions.

Most employers are familiar with industry-standard employee benefits, like medical, dental and vision coverage, tax-qualified retirement savings, and disability and life insurance.  However, some employers may offer or may be asked by employees to offer “non-standard” employee benefits and perks such as lifestyle spending accounts, tuition assistance and pet insurance.  This session will provide an overview of these types of benefits, including federal tax treatment and other federal laws and regulations that may apply.
