On January 12, 2021, Governor Mike DeWine signed H.B. 352, the Employment Law Uniformity Act (ELUA). The new law makes long-overdue, employer-friendly changes to Ohio's workplace discrimination statutory framework. Among other changes, the law makes the following changes:
- New statute of limitations for workplace discrimination in Ohio;
- Imposes new administrative exhaustion requirement for Ohio state law workplace discrimination claims;
- Changes to standard for personal liability for managers and supervisors;
- Applies the U.S. Supreme Court's Faragher-Ellerth defense to harassment-based discrimination claims; and
- Significantly modifies framework for bringing a claim of age discrimination.
